CERES, 13 de abril de 2005.-
VISTO:
La necesidad de llegar a un acuerdo con la Dirección Provincial de Vialidad para lo cual esta Municipalidad ejecutará trabajos de pavimentación en el acceso a la Escuela de Educación Técnica Nº 308 en la localidad de Ceres de acuerdo al cómputo y presupuesto realizado por Vialidad, y
CONSIDERANDO:
Que los términos del convenio y el presupuesto ofrecido por la Dirección Provincial de Vialidad para el pago de las obras a realizar por la Municipalidad son razonables y compensan las inversiones a su cargo.
Que asimismo, resulta necesario simplificar la ejecución del convenio para lo cual es conveniente otorgar facultades a la Municipalidad de Ceres para que la representen y realicen todos los actos necesarios para su cumplimiento como también a percibir la tasa que se establezca.
Que a los fines de garantizar el cumplimiento del convenio corresponde autorizar a la Dirección Provincial de Vialidad para afectar los fondos de coparticipación que le corresponda a la Municipalidad de Ceres.
Que la ejecución de la obra brindará beneficios imponderables a todos los habitantes de la zona.
POR LO QUE:
EL HONORABLE CONCEJO MUNICIPAL DE CERES, EN BASE A LAS ATRIBUCIONES QUE LE CONFIERE LA LEY 2756 Y SUS MODIFICATORIAS, SANCIONA LA SIGUIENTE:
O R D E N A N Z A
ARTÍCULO 1º) Apruébese la formalización de un convenio entre la Municipalidad de Ceres y la Dirección Provincial de Vialidad para la ejecución de trabajos de pavimentación en el acceso a la Escuela de Educación Técnica Nº 308 de la localidad de Ceres, de acuerdo al computo y presupuesto realizado por Dirección Provincial de Vialidad.
ARTÍCULO 2º) Autorizar al Sr. Intendente Municipal Don Camilo Enzo Busquets, DNI 12 814 275 para que suscriba el respectivo convenio como también para que realice todos los actos necesarios para el cumplimiento del mismo y la percepción del monto que se establezca que se efectivizará según se convenga.
ARTÍCULO 3º) Apruébese la inversión que deberá realizar la Municipalidad de Ceres de acuerdo a la Ley 2756.
ARTÍCULO 4º) Autorizase a la Dirección Provincial de Vialidad para afectar los fondos de coparticipación que le corresponda a la Municipalidad de Ceres a fin de resarcirse de los perjuicios que le pudiera ocasionar el incumplimiento del convenio.
ARTÍCULO 5º) Elévese al Departamento Ejecutivo Municipal de Ceres, a sus efectos, comuníquese, publíquese y oportunamente archivase.
